摘要:
我国公立高校现行法人治理结构包括校党委、校长与理事会,但理事会缺乏决策权。这种法人治理结构难以有效避免“内部人控制”、校党委与校长权力冲突、权力腐败以及政府对办学自主权的干涉。而分权共治有利于强化校党委领导、实现利益相关者共同治理、防范权力腐败、保障办学自主权。因此,我们应当在坚持校党委统一领导基础上,增设由内外部利益相关者组成的决策型理事会与监事会,形成校党委、理事会、监事会、校长分权共治格局。
Abstract:
The current corporate governance structures of public colleges and universities in China includes the Party committee,the President and the Council,but the Council lacks the decision-making power.This kind of corporate governance structures is difficult to effectively avoid “insider control”,the power conflicts between the Party committee and the President,the corruption of power,and the government interference in school autonomy.However,the decentralized co-governance contributes to strengthening the leadership of the Party committee,realizing the co-governance of the stakeholders,preventing the corruption of the power,and guaranteeing the autonomy of colleges and universities.Therefore,based on the unified leadership of the Party committee,we shall set up a decision- making council and a board of supervisors consisting of internal and external stakeholders so as to form a decentralized co-governance structure by the Party committee,the Council and the board of supervisors.
