摘要:
相较于传统五伦,公共空间中新伦理关系具有“之间”的特质。在以事物世界为媒介的公共生活和以法律、习俗、礼仪等维系的公共交往中,身体获得前所未有的移动和行动的自由。与此同时,国家通过权力话语将身体及其机能进行规制,陌生他者身体的社会压力以及个体自我对他者身体的敏感度都对身体的自由进行了限制。权利标明了个体在公共空间中的位置,个体之间的相互关系及其对这种关系的承认态度。权利有绝对的理由要求其得以承认并实现,但权利的实现也要求划定权利的边界。身体的自由与规制、权利的实现与边界是公德研究的两个基本问题。
Abstract:
Compared with the five traditional cardinal relationships,the new ethical relationships in the public space have the characteristics of “between”.The public life is constructed by the objective things and the public relations are maintained through the law,customs and manners.In the public life and the public relations,the flesh has the tremendous freedom of movement and action.At the same time,the state regulates the flesh through the power discourse,and the social pressure from other flesh and the self stess from the individual's sensitivity to other flesh regulate the freedom of the flesh.The private right indicates the position of the individual in public space,the relationships between the individual and other individuals,and their recognition of the relationships.The private right has the absolute reason to be recognized and realized,but the realization of the right also requires the boundary of the right.The freedom and regulation of the flesh,the realization and the boundary of the right are the two basic issues of ethics in public space.
