摘要:
自古中国人非常重视"祖宗藏魄之所"即坟茔。坟茔纷争是为重要社会现象,通过对民国时期伪造坟茔文书案卷进行系统梳理,详细解读个案审断具情,分析坟茔争讼的社会场域,探讨该类纠纷解决途径机制及其所反映的社会根源。
Abstract:
Since ancient times,Chinese people have attached great importance to "the places where forefathers hide their souls"-tombs.Tomb disputes are important social phenomena.This paper systematically unscrambles the cases of forging documents during the period of the Republic of China,so as to understands in detail the specific circumstances of those cases,analyzes the social field of tomb disputes,and explores the solution mechanism and the social root of this kind of disputes.
